There’s a major difference between an accident charge being dismissed in court and a claim being denied. One has nothing to do with the other. If you friend was involved in an accident and it was his fault than his insurance should still pay for damage to the other party regardless of whether or not the case was dismissed in court. He should not have closed the claim - he'll need to have the claim reopened. An insurance company can’t refuse to reopen an existing claim. He can't forget about it and hope it goes away. It won't go away

If the case was dismissed, I can't see how the other side could (legally)compel your friend to pay damages or medical bills, unless this was part of a settlement agreement. Assuming that this was part of a settlement agreement and your brother was fully covered, the settlement was reasonable and there was no intentional conduct involved, then the insurance company must pay. If not, lawyer up.

Well, he's told the insurance company not to do anything (really stupid move, BTW), so THEY aren't going to do anything. Courts do NOT dismiss accidents. They CAN dismiss a ticket, but that doesn't make the accident go away!!
The person he hit, is probably going to sue him, and get the judgement. His insurance company, is off the hook - because he told them not to pay it!! SO, HE is probably going to end up paying all the damages out of pocket.
He sure can try to get them to reopen the claim - but they did what they were supposed to, the first time around. He should have discussed the situation with his agent - I think he's screwed himself.

I assume the other celebrations ins. company is asking him to pay the damages. What he should do is get his policy number (the one he had when the accident occurred) and give them his old ins. companies telephone number and let them handle it. i know he hates to make a claim, but he has no choice.
